The titles of the International Trademark Classification and the International Trademark Categories were developed by the Nice Union Expert Committee and are contained in the "International Classification of Goods and Services for the Purposes of Trademark Registration" (Nice Classification), which is published by the Nice Union World Intellectual Property Organization ("WIPO") . The general remarks, category number, category title and notes for each international trademark category are as follows.
International classifications can be found on the WIPO website. However, because the international list is developed to classify goods and services, not to identify specific goods and services, most of the terms are not clear enough to be used to identify goods and/or services. On January 1, 2021, the 2021 edition of the eleventh edition of the Nice Classification (NCL 11-2021) came into effect. The description of the goods or services appearing in the category is a general description of the field to which the goods or services belong in principle. Therefore, the alphabetical list should be consulted to determine the exact classification of each product or service.
If it is not possible to classify products with the help of category lists, explanatory notes, and alphabetical lists, the following remarks specify the applicable standards:
(a) In principle, finished products are classified according to their functions or uses. If the function or purpose of the finished product is not mentioned in any category, the finished product shall be classified by analogy with other comparable finished products and arranged in alphabetical order. If it is not found, other auxiliary standards are applied, such as standards for the materials used to manufacture the product or its mode of operation.
(b) A finished product that is a multi-purpose composite object (for example, a clock with a radio) can be classified into all categories corresponding to any of its functions or intended uses. (d) In principle, goods that are intended to form part of another product are classified into the same category as the product only when the same type of goods cannot be used for other purposes. In all other cases, the criteria under (a) above apply.
(e) Products, whether finished or not, are classified according to the materials they are made of, and when they are made of different materials, in principle, they are classified according to the dominant material.
(f) The boxes suitable for the products they intend to contain are in principle classified into the same category as the products.
If it is not possible to classify services with the help of category lists, explanatory notes, and alphabetical lists, the following remarks specify the applicable standards:
(a) In principle, services are classified according to the activity branch specified in the service category title and its description. If not specified, it is analogous to other comparable services arranged in alphabetical order.
(b) In principle, leasing services are classified in the same category as services provided through the lease object (for example, telephone leasing, which is covered by category 38).
